Terms of Use
The rules for using the Fun Audio Games app and this website, in plain words.
The short version
- The app is free to download. Some extra stories and levels come in packs you buy once, in the app, through the App Store or Google Play.
- Refunds for packs go through Apple or Google, under their rules; for Fun Audio Games Unlimited, they come from us. Your legal rights as a consumer aren't affected by anything here.
- The games you talk to on this website are free to play a few times a day. Fun Audio Games Unlimited, a monthly subscription you can cancel at any time, takes the limits away.
- The games are for you to play and enjoy. Please don't copy, resell or rip them.
- No ads, and no account needed. You can sign in with Google or Apple to keep your place and your packs on every device, if you want to. How we handle information is in our Privacy Policy.
Who we are
Fun Audio Games (called Hear Out Games until November 2026), the app for iPhone, iPad and Android, its watch apps and this website, is made by Hugo.FM Games Limited, a company registered in England and Wales (company number 14615936), trading as Hugo FM. Our registered office is 55 Station Road, Manningtree, Essex, CO11 1EB, United Kingdom, and our VAT number is GB459507559. In these terms, "we" and "us" mean Hugo.FM Games Limited, and "you" means the person using the app or the website.
Agreeing to these terms
By downloading or using the app, or using this website, you agree to these terms. If you don't agree, please don't use them. If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies; from Google Play, the Google Play Terms of Service do. Where these terms and the store's say different things, the store's win for anything about the store itself.
If you're under 18, please ask a parent or guardian before you buy anything.
Accounts
You don't need an account to play. If you sign in, with Google or Apple, you get a Fun Audio Games account, which keeps your place in the games on this website and the packs that are yours. Accounts are for people aged 13 and over. Anyone who can sign in to your Google or Apple account can use your Fun Audio Games account, so keep those secure. You can delete your account whenever you like, on this website's Account page or in the app's settings; our Privacy Policy says what deleting it removes.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to use the app and its games, and any packs you buy, on devices you own or control, for your own non-commercial enjoyment. You can play them as much as you like.
Please don't:
- copy, record, rip or share the games' audio, stories or artwork, or put them on another app, site or service;
- sell, rent or sublicense the app or anything in it;
- reverse engineer, decompile or tamper with the app, or get around the way packs are unlocked, except where the law allows it;
- use the app or this website to break the law, or in a way that could harm them or the people who use them, such as overloading our servers.
The games, their stories, voices, music, sounds and artwork, and the Fun Audio Games name and logo, belong to us or to the people who licensed them to us.
Packs and purchases
Packs are one-time purchases of extra stories and levels for a game.
In the app
- The price is shown in the app before you buy, and you pay through the App Store or Google Play, which handle the payment under their own terms. We never see your payment details.
- A pack you've bought is yours to play for as long as we offer the app, on the devices signed in to the same Apple or Google account. If you change devices or reinstall, use Restore purchases in the Shop to get your packs back.
- If you're signed in to a Fun Audio Games account when you buy, or sign in later, the pack is that account's too, so it also plays on every phone and tablet where you sign in to it. A purchase can belong to one Fun Audio Games account only: the first one it's added to.
- Packs are downloaded from our servers after you buy them. If one won't download, tell us and we'll help, or refund you if we can't fix it.
- Refunds are handled by Apple or Google under their refund policies: ask them through the store you bought from. A pack that's refunded is no longer yours.
On this website
Packs aren't sold on this website: its games come with Fun Audio Games Unlimited instead.
Nothing in these terms takes away your legal rights as a consumer, including your rights if a pack is faulty or not as described.
Fun Audio Games Unlimited
The games you play by talking or typing on this website, funaudiogames.com, are free to play a few times a day. Fun Audio Games Unlimited is a monthly subscription, for a signed-in account, that takes the daily limits away.
- Subscribing takes you to Stripe's secure payment page, which shows the monthly price, including any tax, before you pay: in pounds in the UK, in euros in the eurozone, in Canadian dollars in Canada, and in US dollars elsewhere. Stripe handles your payment details under its own terms; we never see them.
- The contract is made when Stripe confirms your first payment. Unlimited starts straight away and renews every month, at the price you agreed to, until you cancel. If we ever change the price, we'll email you at least 30 days before your first payment at the new price, and you can cancel before then.
- You can cancel whenever you like: ask the games to cancel it, which opens Stripe's page for managing it, or email us. Cancelling stops the next renewal, and Unlimited lasts to the end of the month you've paid for.
- Your right to cancel: because Unlimited starts straight away, the payment page asks you to agree to that, and to accept that you lose your 14-day right to cancel once it starts. You can't subscribe without agreeing. Stripe's receipt, sent to the email address you give on the payment page, confirms what you agreed to.
- If a payment fails, Stripe tries it again for a while and Unlimited keeps working meanwhile; it ends if the payment still can't be taken.
- If Unlimited doesn't work as described, email us (below) and we'll put it right or refund you. Deleting your account cancels its subscription straight away.
Speaking to the app
When you answer out loud, your device's own speech recognition, from Apple or Google, turns what you say into words for the game. It's covered by their terms and privacy policies, not ours, and what you say is never sent to us. You can always type or tap your answers instead. Our Privacy Policy explains everything the app does send us, and how to turn it off.
Changes to the app
We keep improving the app and may add, change or remove games and features. We'll try to keep every pack you've bought playable. If we ever have to stop offering the app, we'll give you as much notice as we reasonably can.
Our responsibility to you
We make the app with care, but games can have bugs, and we can't promise it will always be available or free of errors. If we break these terms, we're responsible for loss or damage you suffer that was a foreseeable result of it. We aren't responsible for losses that weren't foreseeable, for business losses (the app is for personal use), or for problems caused by your device, its software or your connection.
Nothing in these terms limits our liability where the law doesn't allow it to be limited, including for death or personal injury caused by our negligence, or for fraud, and nothing affects your legal rights as a consumer.
The law that applies
These terms are governed by the law of England and Wales, and you can bring a claim about them in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your own courts, and if you live elsewhere, you keep the protection of your own country's mandatory consumer laws.
Changes to these terms
We may update these terms, for example when the app changes or the law does. We'll put the new version on this page with its date at the top, and if a change matters, we'll say so in the app's update notes.
